Terms of Service

Please read these Terms of Service carefully before using WhatsLead. These terms constitute a legally binding agreement between you and WhatsLead regarding your use of our platform.

1. Acceptance of Terms

By accessing or using WhatsLead (available at whatslead.in), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

2. Description of Service

WhatsLead is a form-building platform that allows businesses to create lead capture forms and receive responses via WhatsApp. We provide tools to build, share, and manage forms, and to view and export response data through our dashboard. Features available to you depend on your subscription plan.

3. Account Registration

You must create an account to use WhatsLead. You agree to provide accurate, complete, and current information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at care@whatslead.in if you suspect unauthorised access.

4. Subscription Plans and Payment

WhatsLead offers a Free plan and a Pro plan (₹999/month + GST). Subscriptions are billed monthly. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' prior notice. Your continued use after a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to use WhatsLead to: (a) collect data without the consent of the individuals concerned; (b) send spam or unsolicited messages; (c) distribute malware or harmful content; (d) violate any applicable law or regulation including the IT Act, 2000 and TRAI regulations; (e) impersonate any person or entity; or (f) interfere with the integrity or performance of the service. We reserve the right to suspend or terminate accounts that violate these terms.

6. Data and Privacy

Your use of WhatsLead is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you collect through your forms. By using WhatsLead, you grant us a limited licence to process and store that data solely to provide the service to you.

7. Intellectual Property

All content, features, and functionality of WhatsLead — including but not limited to software, text, graphics, logos, and icons — are owned by WhatsLead and are protected by Indian and international intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our platform without prior written permission.

8. Third-Party Services

WhatsLead integrates with third-party services including WhatsApp (Meta Platforms Inc.). Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.

9. Limitation of Liability

To the maximum extent permitted by applicable law, WhatsLead shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the service. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

10. Disclaimer of Warranties

WhatsLead is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or at our sole discretion with reasonable notice. Upon termination, your right to use the service ceases immediately. You may also delete your account at any time from your dashboard settings.

12. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our platform. Your continued use of WhatsLead after the effective date of changes constitutes your acceptance of the revised Terms.
